My photos stolen by an ebay seller !

Just noticed on ebay that a seller has stolen a photo from my website and is using it for commercial gain on ebay.

Here is the link to my picture:

I have saved the ebay listing so they cant just delete it and expect to get away with it.

This is clearly infringement of copyright, anyone have any links on how to proceed ?

They have used it for commercial gain which must mean I can claim.

The ebay seller doesn't seem to be registered as a business seller but is obviously running a business. So that's dodgy to start with. Either way it's very sloppy of them to not make their own image.

I think the best you can hope for Mark, is for them to pull the photo under threat of action - tell 'em you're pursuing it & have already instructed your legal people to act, but you'll tell them to stop if the photo is whithdrawn.

In a couple of weeks, make a call to Inland Rev.

Sorted it out, a strong email did it.

If it had been hotlinked I would have replaced the hotlinked file with a picture of big pair of tits and left the url the same :eyebrows: but was embeded in ebay picture service so could not do that this time.

Just the principle of it that is annoying.

Only really works for big images, though Chris - otherwise you can just Print Screen and use an image editor to cut the picture you want...

Have you thought about "watermarking" your images with your name, Mark?

You beat me to it Alex! I had my pictures stolen on eBay about 4 years ago, not only did they steal the pictures, but also my carefully worded listing description too :steam:

I watermark my important sales now with my eBay user ID and I also contacted eBay about it, who were very helpful. The seller was rude and denied it all, saying I needed to get a life if all I was worried about were things like that!

You are correct, in fact you can do it with Windows Paint too, or any other capture tool. Or just copy them out of your browser's cache folder. All the prevention tools do is stop you right clicking and saving, but once it's on your screen it's yours if you want it, you just have to know how to get it :eyebrows:

The text on that site is just abut a copy and paste of my text :(

I will have to start adding a large watermark on all my photos.

The new photos I take take now have a logo on , I recently added some Oppo BDP-93EU region free mod kits to my website and the picture has a logo diagonally across it that would be difficult to remove:

Click the photo to see the large version, that should stop the copying :)

Did you use the 'complain about this listing' button on the offending item?

I've had this happen and eBay closed the listing with 24hrs and set me an email to tell me they'd taken action.

Not sure what you can do off eBay though without legal action. Might be worth a call to your local business link or CAB for advice?

This has happened to me loads of times. I start off in most cases with a polite email - 90 % of the time I get an apology and the photo / description removed. If I don't get a polite response within 24 hours I report the listing, If I get a stroppy one then I threaten legal action, I have never had to go that far though.
It is most annoying but the cost of taking any action is likely to be huge and the return on investment nil.

Yes I did. Never mind, the item has ended now and I'll stay out of it. The winner is likely to get a nasty surprise when they see their 'SCD-1' :(
