As the original thread has been closed I've started another as I have more to say. My agreement with Marco is that once the amplifier has been repaired it will be auctioned off. He will then deduct £43.21 from the total and send it to me, this is what it cost me to send the amplifier to him, the remainder will go to Cancer Research UK.

I see from the original thread that there are still people who doubt my side off the story so I will say again, I sent Marco proof in the form of copies of the original emails of my request to Wood to build and supply the amplifier and his acceptance of the order plus the court judgement in my favour. The court bailiffs visited Wood's address numerous times but the coward went into hiding so to date I have not received what the court ordered him to pay me.
Also, the order I placed was for a new amplifier at the agreed price of £1,300.00 but the amplifier I received was second hand. The whole episode has caused me a lot of stress and sleepless nights and I'm considerably out of pocket.
Everything I've said is the truth, although I rarely go to church I'm a Christian and do not tell lies.

Indeed a tale of woe Geoffrey. Just make sure you allow for the costs of transporting it properly packaged with tracking and insurance. I purchased a valve phono pre-amp of overseas. It was well packaged as you can imagine. The valves were snugly placed in cutouts of just the right size in a polystyrene block. That takes more effort and money but it is worth the peace of mind.

That kind of sums up how this situation got to where it did if you ask me! We can all choose when to speak and when to let things lie.. Seemed a bad move to come on to a public forum in my personal view.

I bet if you could go back in time, you would just send the amp back, get your refund and put it down to mis-communication or poor customer service. Would have been a less costly and a LOT less emotionally stressful.


As a general aside, I don't see court judgments in small claims as proof of anything other than a win at a small claims. Whether they be a technical win, that the other guy didn't turn up (think that's true the first time around here isn't it?) or presented a poor defence or whether it was a correct and moral judgement, its really nothing more than a piece of paper with a legal backing, however you get it.. I've read of all sorts of cases on consumer advice forums where people and companies have made unjust demands and won because of poor or no defence for example.

Anyway, I doubt this thread will be allowed to drag on again with everyone saying the same things over and over!

It's too difficult to assess all the comments but ultimately the whole sorry tale seems to be based in mis-communication. I'm not saying it's necessarily 50/50...I really don't know.

I think you should have let this lie. Raking up the same stuff is going to achieve nothing and this smacks a bit of self justification. It is inevitable that there will be some who naturally feel that one side or the other in any situation feels more likely. Its a fact of life.

This went to the court three times. Latterly the High Court. That is the method we use in this country to ultimately resolve disputes such as this. I am familiar with the process as part of my work. it is not easy to win as the plaintiff, you need to present a solid case and even then you may not get full judgement.

That doesn't change the basic fact that there are those that have no faith in the 'system' and will draw their own conclusions from the evidence 'they' have seen. As I said, this is human nature. Those that admire the OP for his fortitude and for giving the amp to charity have already expressed their support, whilst those of us that any doubts have also expressed their views. Raking this up again is going change no minds and will achieve nothing.

Guys, the original thread was closed for the very reason of NOT regurgitating the argument of 'who was at fault?', as the discussion was becoming circular, and that's precisely what's happening again on this thread! :doh:

In retrospect, Geoffrey, you should've thought twice about starting a new thread, other than with the intention of reminding members how the matter is to be resolved, which you've done. Therefore, other than discussion pertaining to that *specific* matter, and how the auction should be carried out, further input will be removed without further warning.
