Ebay....again.

I bought an item of clothing which was described as "one size fits all". When it arrived it was enormous and could have swallowed 3 of me. I sent it back and as the terms of returns was that it had to be back with them within 5 days of the date of purchase, I sent it first class. Their terms were that they did not refund their postage paid when I bought it.

I am now out of pocket over £10 and have nothing to show for it. Would I be justified in starting a grievance with ebay with regard to unfair terms, or am I f*cked?

Expecting items to be returned in so short a time is probably impossible. I would open a case against the seller as the return time is too short. In fact it's ridiculous.

It may even be illegal. Don't the distance seller regs stipulate a 14 day cool off period?

eBay rules/policy are that the buyer covers return postage. If you buy privately that stands, but if buying from a trader the DSR's apply and you have no obligation to comply with eBay rules or even return the item to claim a full refund including postage. You just tell the seller that you want 'a full refund' and leave them to arrange collection of the unwanted item! I try to be reasonable with sellers if there's a snag, as it is often something unforeseen or just unfortunate, so a bit of flexibililty won't hurt. If you comply with eBay rules, you probably void your rights under the DSR's though.

I bought a pair of speakers off ebay and one has arrived damaged. I have messaged the seller, but he has not responded as yet. Would I be right in thinking that it is for him to take up with the courier?

Yeah.. he booked it so he should have all of the documentation. Unless you wish to do it yourself? If that's the case you will need the booking details etc.
