View Full Version : Here we go again....what do I do?

After a previous problem with the buyer of my speakers on ebay saying that they weren't working although I knew they were,the next set I sold was collection only so the buyer could hear them first...that's me covered or so I thought:scratch:
Sold my b&w dm2 mk2 a couple of weeks ago and the buyer came,had a listen and took them away....today he calls me and say the bass driver in one of them isn't working and that its not vibrating as it should..he says its "stuck" and has opened a case on ebay(looking for full refund)....I know they were working as I played tracks from an Usher Sampler cd for him(got at a hi fi show) many of the tracks really show the separation and very obviously show they are both working
Anyway...what I need to know is: Would this just "happen" could he have done something that may have caused this? How can the bass get "stuck"?
Any help greatly appreciated...ta in advance

Too much power put through an old speaker. The voice coil has overheated and the laqueur has softened or burnt and the coil has distorted and expanded sticking in the magnet gap. Probably open circuit now too! Sheer abuse.

No, if the cone won't move the unit is buggered. A slightly rubbing coil is another matter, it's often due to 'suspension droop' and rotating the drive unit can allow gravity to correct this.

Some people buy hi fi that is working perfectly only to pump the speaker to within an inch of its life or wack the amp to ear bleeding levels for ages then try to make out you've sold them a dud when the thing goes splat ! or prang !! Too many clueless idiots out there - It's a shame !! :rolleyes:

He has no case....AT ALL!!!

He took the speakers having heard them - if you offered no warranty (which I assume you did not on 2nd hand gear that were sold on an as seen deal) then there is no case at all.

Anything could have happened - Ebay will rule in your favour. Do not refund any money - it's a scam - he gets the refund then sells them on.

The only offer you can make if you feel so inclined is to get him to bring them BACK to you and you give a refund (less costs and the 10 plus 4 percent that ebay charge).

This of course will not happen as there is nothing actually wrong with them.

Take the advice given earlier in the thread - do not sell high or even mid-ticket HiFi equipment on Ebay now - it is simply not worth it. It is so full of scamming now it's like a minefield of deceit.

Unfortunately eBay tend to side with the buyer.

I had an instance recently where a buyer did something similar over a perfectly good camera I'd sold them. They lodged an eBay dispute against me a week or so later after having buggered the camera up (they'd even left positive feedback saying they were happy with it). So I said return it for a full refund on the understanding that I would have the camera examined by a professional camera engineer for signs of abuse and would pursue the buyer though the small claims court for the value of the camera and the examination costs and any other costs should the defect be their fault. They immediately withdrew their claim for a refund!

Yep, fuck eBay. After several scams of this sort I started to develop a dim view of the world. Just not worth it IMHO, only use it for cheap CDs these days.

I still frequently buy faulty gear, fix it & sell it on using eBay as my main marketplace. I would say that 7/10 items I sell go abroad... Its been like that for around 2 years now & I've only encountered one foreign scammer who was so transparent even PayPal sided with me... Now out of those 3/10 sales within the UK I reckon 2/3 are scammers... Very rough figures here but you get the picture.... When I see an item's sold to a UK based buyer I cringe & await the inevitable "buyer has lodged an item not as describe dispute" blah blah blah.

I don't know if its 'cos everyone's skint & 'on the blag' or what but I'm seriously considering adding 'buyers from within the UK will be blocked' to my listings :lol:

Yes,I do believe that's has happened...he first called me and asked to bring the speakers round(he doesen't live far) saying the bass was stuck and asking for my help,I agreed he could bring them,but then remembered I had family coming to stay so emailed him and suggested I bring my amp around to him in case his amp wasn't working properly...that's when he opened the case through ebay,saying they were not as described and asking for a full refund,I think he's accidentally done something to them as they were definitely working and I wouldent be asking for the buyer to come around and hear them if they weren't....the last line of my listing goes like this:"Cash on Collection only as they are very heavy and I want the new owner to hear them before taking them away"....he also left me positive feedback....I am just wondering what he may have done,accidentally or carelessly as he was a very nice person and seems to have good(?) quad equipment ....I will call ebay later today to explain what may have happened

Yes Stan,Im well aware of this...I don't allow paypal and then collection as the seller then has no proof that the buyer has received the item....if a buyer claims he hasn't received it,the seller has to provide tracking and signature from a reputable courier service which cant be given if the item was collected...he paid cash on collection after hearing them...

Im going to call ebay today and need a small list of reasons of how he has "stuck" the bass,whether accidentally or not

Well if he paid cash then you don't have any legal agreement with ebay with regards to refunding him his money. The UK consumer laws applicable on goods paid in cash and collected in person are what counts. All you are responsible for as far as the ebay financial side is concerned is the listings fee and the ebay sales commission. Nothing else. Neither ebay or Paypal can take money out of your account to pass onto someone else if that person has not used their services to pass money on to you.

He is claiming that I must have been unaware of the "mechanical" fault with one of them so unwittingly sold him faulty speakers
But they sounded ok to me and indeed to him when he came to pick them up and I played a few different types of music through them for him..
Funnily enough,the tracks had plenty of bass,so if one had this "mechanical fault" he is talking about wouldent either of us have heard it?:scratch:

If he went to look at a second hand car, test drove it, happily handed over the cash on a sold as seen basis & then a week later the head gasket went would he be asking the seller for a full refund or accept the fact he should have taken a mechanic with him to make sure it was kosher before handing over the dosh ?

I'm not trying to imply the driver may have been on the way out so please don't think that - Just trying to highlight how daft & nonsensical it is. Sounds like your bog standard ten a penny eBay muppet thats either accidentally blown it playing too loud or connecting/disconnecting wires whilst the amps turned on [blown a B200 myself this way!] or he just changed his mind & deliberately damaged it in order to get rid of or at least a hefty partial refund.

Tell him to poke 'em up his arse.... Unless he's bigger than you :lol:

Sounds as though he's wriggling and squirming a bit. I don't see how you can be held accountable. It was a private sale of forty year old speakers who's durability is largely down to chance. He must have been satisfied when he took them away and to come back a couple of weeks later is just nonsense. Did you say in the listing that they were 'sold as seen' by any chance? To expect to see each driver tested is unreasonable as it would have required the dismantling of the speakers. As has been pointed out, it was a cash sale and there's no 'legal' basis for interference from eBay or PayPal. And for goodness sake don't go round to his place. He can't legally dump them at your address by the way.

Here is my original ad wording....in the return section its says "no returns accepted"
"Highly regarded pair of Bowers and Wilkins vintage DM2 mk2 classic studio monitor speakers that come with their optional original stands.They are very highly rated by those in the know and pretty hard to find nowadays. I had intended to refurbish them with a bit of rubbing down/danish oil and I even went so far as to buy new acoustic grill cloth for them but I just havent got the time,so heres a chance for a bargain for someone. I will include the new grill cloth with the speakers,but if I get around to it I will recover them for you. Ive been using them with my Inca Tech Claymore amp(also listed) and they have been used with Naim and Exposure amps as well. They sound awesome and all drivers are perfect.

As mentioned earlier,they could do with a bit of cosmetic tlc as although it doesent show it in the pics too much,they have use marks etc on them,but as I said,an easy job to do if you desire and the sound isn't affected in any way.

Google them and you will find lots of info on them.If you want to hear them first...just get in touch.

but can someone please tell me if the bass driver was stuck as he says...would we hear it? I was under the impression that there would be no bass from one speaker...is this true?....he is intimating that I myself was not aware that they were faulty,and that as he didn't test ALL SIX DRIVERS he didn't find the fault

I always believed it woulden't sound right,or at all...and would be very obviously not working properly....

It all hinges on him hearing them....being satisfied...and taking them away.....and leaving me positive feedback...any damage he done afterwards is not my concern,but I am being careful as ebay may still rule in his favour if the wording is incorrect or I seem like I deliberately scammed him,which I would never do.

Yep, probably hooked them up to a crap amp & cranked it up, which clipped to hell & fried the coil...

I can't see the relevance of anything he says. He paid cash, he collected, he listened before he left. A condition of the sale was no returns. Why would eBay consider any action?

If Ebay know the buyer collected after listening to the speakers and still opened a dispute, then that doesn't make any sense to me. Whatever happened to 'sold as seen' complete and working at time of sale. All this means is people can buy stuff, knacker it up and them blame the seller.

Sounds to me like he's just trying it on and like others on here say he probably connected them up to an inefficient amp, cranked the volume up, blew them to kingdom come and is now trying to winse out of the deal!

Tell him your really sorry to hear that this has happened but as they were sold as seen, tough tities!

He had now taken the bass driver out of the speaker and found lots of white corrosion on the chassis of the bass driver....he says that is whats caused the fault...he has sent pics of it to ebay.....would corrosion cause the voice coil not to work? Believe me guys.....the speakers WERE working when he took them!!!.......HEEEELLLLLPPPPP....I will try and post the pics he has sent

If this guy has hooked the DM2's up and subsequently destroyed them by driving his amp into clipping (it would have to have been a really weedy amp to have run out of puff driving a pair of these speakers, a cheap T amp perhaps?) then he has probably destroyed the Coles super-tweeters as well... :eyebrows:

Corrosion is common on the alloy parts of older drive units. As long as the speakers were working, it has no bearing on the matter. He obviously hasn't a clue what he's talking about and bought them as demonstrated in any case. It would be unreasonable to expect you to have taken the speakers apart to check the internals prior to sale. Is he (or eBay) qualified to make any kind of judgements?

As Geoff says above, corrosion on the chassis of older drive units is common, it has no effect on the sound what so ever. If one of the bass units was jammed/stuck it would have been instantly audible, no question of that. The most likely reason for this problem is that an older speaker system has been over driven and this has caused the coil to deform and jam, it may also have gone open circuit. If th guy heard them, took them away and then started the dispute weeks later he has no case, end of story. Don't accept them back under any circumstances and don't go over to him to check them out as this could be construed as you accepting responsibility. Write to him stating plainly the facts, i.e. The worked when he checked them out, any mechanical jamming would have been audible at the time of inspection and that any damage is his fault. Copy this to eBay and tell them there are a number of audio consultants who would verify this position.

Its not been unknown for someone to own a pair of speakers in need of a new driver/tweeter to buy a pair off eBay, swap the drivers over & send them back as faulty. Probably hasn't happened in this instance but I would advise anyone selling anything valuable to mark it with a security pen before handing it over.

Whats the current state of play ? He has opened an item not as described dispute on eBay or PayPal & will have [I think] 7 days to escalate it to a 'claim' which gets eBay/PayPal directly involved... Had he paid with PayPal they would put those funds on hold until the case has been reviewed by a claims judge or whatever they're called. As he paid with cash I don't think there's anything they can do... I had this recently when I sold a mint mobile phone - The buyer paid cash on collection, 6 days later its apparently gone faulty & the buyer opens a claim but as he paid cash they just sent me a message saying In their opinion I should refund him & its the right thing to do etc etc... Suffice to say I deleted the message :lol:

There are people who make a living out of getting items and then pursuing chargebacks. I know this guy paid cash, but for anyone else facing a Paypal dispute, go through the buyers feedback and email any previous sellers he's dealt with.

One little twat tried a fraudulent chargeback with a mate after (unsuccessfully) trying the same with me and getting away with it from another friend. My mate contacted contacted all those who had previously sold to this guy and found 17 people he had pulled the same trick with. EBay suspended him for 3 months on the evidence and the dispute was withdrawn. As sellers can't leave a negative feedback, these little turds can get away with murder time after time and nobody can see the evidence.

I gave up on EBay for these exact reasons. I just don't sell anything on there now and would advise anyone else to do the same.

Good luck with this, i learned the hard way..When it gets to the stage when you on edge for a week or so waiting for someone to try it on it's pretty much time to give up...So i did, never sold since.

I sympathise with the OP. It's not certain that the buyer has deliberately done anything wrong to damage the speakers but by far the most likely explanation is that they broke after they were sold. If the buyer was given the opportunity to inspect them then I think the transaction completed when the buyer took them away and paid for them.

Hopefully eBay will side with the seller, especially given the "no returns" condition on the listing. If the seller admits any kind of liability it is likely that eBay will jump on this and refund the full purchase price so I think in the circumstances I would send the buyer a message saying that no returns are accepted and not enter into any more correspondence - wait for the case to be settled by eBay.

If the OP feels sympathy for the buyer then once it is complete you could offer to make a contribution towards a repair, but there is no requirement to do that, and you will open yourself to yet further stress.

I do not wish to offend you as you have been completely had in this case - he has taken the speakers and either damaged them OR MORE LIKELY has used them for spares to repair some of his own.

Liars and cheats are sometimes the nicest and most intelligent of people when you meet or deal with them. The other term more often used to describe such people is a criminal.

Give the f***********er his money back but make sure he brings the speakers back to you at his cost. Get them fixed (I am sure there are some honest folk here who will help you) and sell them via this or another forum to an honest end user.

I am sorry this has happened to you but like others here I'm sure thank you for sharing this whole sorry affair on the forum......a lesson to us all I feel.

1. You sold them as seen with no returns stated in the listing. That's end of story, he inspected them, was satisfied with them and took them.

2. That you sold them on Ebay is neither here nor there. They were not involved in the payment processing, so cannot involve themselves in any refund. That would simply be theft of money from your Paypal account. Remember, Payapla, and Ebay are not the same company, this transaction has nothing to do with Paypal.

3. Should you ever wish to make yourself safe from a Paypal charge back, simply remove the link to your credit card or bank account from your paypal account before the charge back is made. they would have to pursue you through the courts/debt collection.

4. The truth regarding the condition of the drive unit is that neither you nor the buyer inspected and tested every unit. You did however state in the sale that 'all drive units were in perfect condition'. However he accepted the condition and paid for them, so it doesn't matter if the drive unit was actually working or not.

5. What has most likely happened is that he has burnt out the drive unit coil. The corrosion is a misdirection all 20+ year old drive units will have some furring. My suggestion would be that you tell him that his best course of action would be to acquire another pair via ebay and to strip them for spare parts. ;-)

Bottom line, you are under no legal obligation to him. It was a cash transaction, so any attempt to recoup funds via a third party would be theft.

Now that he has opened a sealed unit the games a bogey...he could easily have swapped the drive units or anything really...if it was a cash sale then he will have to take you to court which he wont.

You are not a dealer George so the Distance Selling Regulations do not apply to you. It is the buyer's responsibility to examine the goods before purchase and the exchange of cash for goods implies that the buyer was satisfied with the transaction and formed the core basis of the contract between you. If all the drivers fell out of the cabinets during his journey home in the car, then he should be kicking himself not you for failing to inspect them properly.

Well after at least 4 other messages to ebay resolution from the buyer, this was my final response a couple of days ago:"Anthony,Please stop twisting my words,and please stop saying I did not LET you hear the speakers individually.You may recall I actually POINTED IT OUT and turned the balance on my amplifier so you did hear them individually.There was NO masking of a faulty driver as there was no faulty driver to begin with!!Corrosion can be found on the chassis of most 40 year old speakers and it doesent affect the sound or prevent any movement.There are a number of reasons why a bass unit stops working and corrosion on the chassis isn't one of them! Don't say you did not notice that one of them wasn't working,despite me playing you a speaker test cd,and then only noticing that one wasn't working more than 2 weeks later!!And now you have even dismantled the speaker. For the last time: You were NOT misled,you DID listen to the speakers before taking them,you WERE satisfied and paid and left me positive feedback.I cant be held responsible for how you have (mis)used them over the last few weeks".......
He then escalated the case to customer support at 9.03 this morning:

At 9.03 this morning I received this message from Ebay customer Support:

"Case has been escalated to Customer Support"

"Customer Support comments:

Since eBay Money Back Guarantee only covers items purchased with PayPal, we decided not to issue the buyer a refund. You don't need to do anything else for this case.

Final decision:
You weren't found at fault."

Looking at the timestamps it looks like it took Ebay less than a minute to make that decision!!!

MANY,MANY thanks to all of you for taking the time to post on this subject:) I already knew the legal position when I posted at first,but it was the technical part and how that could have happened to perfectly working speakers in a couple of weeks were beyond me....once again AOS members have come up trumps and rallied to the cause of fair play....THANKYOU:cool:

I sold a pair of active speakers on eBay the other day to a UK buyer :rolleyes: buyer has sent me a item not as described message today saying my claim of 60w per driver / 120w per speaker is rubbish as they have poor bass compared to his 35w B&O S35's ... WTF !? Isn't that comparing apples to oranges ? And since when has wattage alone had anything to do with bass quality !? Makes me wanna bitchslap the mofo :steam: GRRRR

I never sold anything on ebay, but i've bought many things already.
Lately i've tried to buy some stuff (small stuff, boxed, and perfectly possible and cheap to send by royal mail), and the seller didn't accepted to send it, and was not understanding why, and only after that, someone explained to me about some scams over there (which i couldn't even dream of)..
One of the moust common now, is for example from guys that have a damaged items (like a damaged woofer in a speaker :lol:), search the ebay for a good working similar item, buy it, and then opens a dispute claiming that "the item was not as described".. and if he wins the dispute, he would have his faulty item replaced for a working one at ZERO cost... Isn't that great...
I know what i would do to this kind of people :chainsaw: :dynamite:.

Unfortunately this seems like a regular thing nowadays.....a friend of mine just sold an amplifier and had to refund the buyer because the phono stage wasn't working although it was working before he sent it.....when he got it back and opened it up....the phono stage was gone!!!!!:eyebrows:
